Break-in fail: home intruder crawls in through the doggy door, comes face to face with a gun owner

A spokesperson for the Jefferson County sheriff’s office says a homeowner who shot and killed an intruder last Friday will not be charged, per Colorado’s castle doctrine.
The doctrine, also known as the “make my day” law, permits a person to use deadly physical force against an intruder as long as “that other person has made an unlawful entry into the dwelling.”
Authorities say Garry Liebreth, 52, entered a man’s home on Clearview Drive shortly before 8:30 a.m. The man woke to a dog barking in the yard, and went downstairs to find Liebreth entering through the doggy door.
“As soon as he made entry into the home, I believe he was contacted by the homeowner,” said Mark Techmeyer, a Jefferson County sheriff’s office spokesperson.
The man reportedly retrieved a firearm from his bedroom. He then told Liebreth to leave, but the intruder advanced.
According to reports, the two men struggled and Liebreth managed to tackle the homeowner. The homeowner then shot Liebreth in the leg and the head before going to a neighbor’s house to contact police.
Liebreth reportedly had family in the nearby Denver area, but authorities said he had no known relations to the homeowner.
Monday’s press release on the incident stated it was “not clear why the suspect picked that home or entered the residence.”
Authorities have not identified the homeowner or specified the type of firearm used during the altercation.
Liebreth was a father of two, according to an obituary.
