Richard Combs murder trial: Former police chief shot dead unarmed man Bernard Bailey

A former small-town police chief accused of murdering an unarmed black man in 2011 looks set to be retried after the judge declared a mistrial when the jury returned deadlocked at 9-to-3 for a guilty verdict.

Former Eutawville, South Carolina, police chief Richard Combs issued a traffic ticket to a young black woman who then called her father to the scene for help. When 54-year-old Bernhard Bailey arrived, he argued briefly with Combs over the ticket, but they soon parted ways.

When on May 2 Bailey went to the Eutawville town hall to contest the ticket, combs attempted to arrest him for obstruction. Bailey returned to his truck and started the engine. Combs reached in to switch off the ignition and a scuffle broke out.

Combs then shot Bailey three times, killing him. Combs says the car was rolling backward and he feared for his life.

A prosecutor in the trial described the killing as “an absolutely senseless act of violence". The 12 jurors—seven black and five white—failed to reach a unanimous verdict after 12 hours of deliberation. Nine voted to convict Combs of either murder or involuntary manslaughter. A retrial date has not yet been set.
