Child safety policy

Dailymotion has zero tolerance for content involving children being physically abused or sexually exploited. If your account is found to have shared such content, the content will be immediately removed and your account will be promptly terminated. Furthermore, if Dailymotion believes a child is in danger, we will report the content to law enforcement and assist with any investigations.

I. Prohibited Content Involving Minors

A minor is defined as a person under the legal age of majority; usually anyone younger than 18 years old in most countries.

If you are sharing content on Dailymotion, note that Dailymotion strictly prohibits any upload of content involving minors which fits any of the descriptions below:

  • Sexualization of minors: Sexually explicit content featuring minors and content that sexually exploits minors. We report content containing child sexual abuse imagery to the local authorities.
  • Dangerous acts involving minors: Content showing a minor participating in dangerous activity or encouraging minors to engage in dangerous activities that may lead to injury, including dangerous stunts, dares, or pranks.
  • Infliction of emotional distress on minors: Content that could cause minor participants or viewers emotional distress, such as simulating parental abuse, coercing minors, exposing minors to mature subjects, or threatening violence.
  • Cyberbullying and harassment of minors: Content that targets individuals for abuse or humiliation; reveals personal information, such as email addresses or bank account numbers; records someone without their consent; sexually harass; or encourages others to bullying or harassment.
  • Intentionally misleading family content: Content that intentionally misleads viewers by appearing to be family content, but contains sexual themes, violence, obscene, or other mature themes not suitable for young audiences.

II. Reporting Content Involving Abuse of Minors

Images and videos of minors being physically abused or sexually exploited are strictly against Dailymotion policies, and are illegal in most countries in the world.

If you see images or videos on Dailymotion of a minor being physically abused or sexually exploited, we ask that you:

  1. Please contact your local law enforcement immediately in the event of an emergency (ex. assault in progress). They may be able to identify and rescue the child.
  2. Report the content or video to our Support Team: by using the “Report” button below each video.
  3. Notify the local entity in charge of Child protection on the Internet.
  4. Don’t share or download the content. It can be a crime to share or send messages that include images and/or videos of children being sexually abused and exploited. You won’t be asked to provide a copy of the content in any report.

III. Age Restricted Content

We may add an age-restriction to content that includes any of the following:

  • Harmful or dangerous acts that minors could imitate: Content containing adults participating in dangerous activities that could be easily imitated by minors. Note: We may allow this content without restriction if the content itself warns minors not to perform the dangerous activities and explains the need for professional adult supervision.
  • Adult themes in family content: Content meant for adult audiences, but which could easily be confused with family content. This includes cartoons that contain adult themes such as violence, sex, death, etc. Remember you can age restrict your content upon upload if it’s intended for mature audiences.
  • Vulgar language: Some language is not appropriate for younger audiences. Content using sexually explicit language or excessive profanity may lead to age-restriction
  • Other sexual content or content involving nudity: We may also age-restrict content if it includes other content involving nudity or other sexual content but doesn’t depict anything described above.

Please note this is not a complete list; do not post content if you think it might violate this policy.

Please note that this policy applies and is not limited to videos, video descriptions, live streams, and any other Dailymotion product or feature.

IV. If you are under 18

If you are under 18, you may only use the Dailymotion Service if:

  • (i) you are above the minimum age required by the law you are subject to, depending on where you live, in order to create and manage an account on Dailymotion (“Minimum Age Required”) (e.g. 13 years old in the US by application of Children’s Online Privacy Protection Act, “COPPA”), and
  • (ii) allowed by law to enter into a binding contract.

Please refer to Dailymotion’s Privacy Policy for further information related to the Minimum Age Required. Please remember that if you are under 13 years of age, you should not use the Service.

If you comply with the above two requirements, and you regularly use Dailymotion, we ask you to carefully read the following information and advice

  1. Tell your parents if you create an account on Dailymotion. It is important to have their agreement, and to explain to them how you plan on using the site (to upload or share videos, create playlists, etc.);
  2. Never give your personal information to other users. If your videos contain personal information or you do not want them to be public, consider making these videos “private” by using the “visibility” option in the video edit page. You can share private videos only with people you want to; and
  3. Don’t hesitate to report any shocking content or behavior by using the “Report” button beneath each video. You can also contact the Dailymotion Support team at any time by using the contact form, accessed via the footer.

If you do NOT comply with the above two requirements, you must obtain parental consent from your parent(s) or legal guardian(s) before creating an account and accessing the Dailymotion Service. When you access the Dailymotion Service, we may collect information about you which may be considered personal information, hence if you do not meet the Minimum Age Required you cannot give us consent to collect such information, instead such consent must be given by your parent(s) or legal guardian(s).

If we discover that you are using the Dailymotion Service and do not meet the Minimum Age Required and are doing so without parental/legal guardian consent, we will promptly delete your account and any data we may have collected associated with it.

Dailymotion provides the tools necessary to ensure a safe experience for its users, particularly minors. On Dailymotion, and on the Internet in general, it’s important to be prudent just as it is in daily life.

Therefore, we encourage parents to talk with their children about how they use Dailymotion, especially concerning the videos they watch, and what they upload and share with others. If minors are using the Dailymotion Service with your permission, it is important to remind them that they must always respect the Terms of Use. Also, it is important to make them aware of the various tools available to protect their personal information, to manage and monitor your child’s communications on the site, and to immediately report any inappropriate activities or content you may encounter.

VI. More Resources

As a French company, Dailymotion has signed the European Safer Social Networking Principles and is actively involved in raising awareness of Internet risks amongst both children and their parents. Also, in order to take an active role in raising children’s awareness of Internet risks, Dailymotion sealed a partnership with the French association E-Enfance. Association E-Enfance aims at allowing children and teenagers to make a safe use of new technologies of communication (Internet, mobile phone, network games). E-Enfance has also the role to advise parents so that they can exert an authority as “cyberparent”. To this end, E-Enfance has uploaded a video on dailymotion aiming at pointing out some essential principles regarding the use of the site. This video can be found on our website and on E-enfance dedicated page.

Complementary to that partnership, in the frames of the European Charter signed in February 2009, Dailymotion joined the safer Internet program – represented in France by “Internet Sans Crainte” – in order to promote good and safer practices on the Internet. Dailymotion, as an affiliate to the Vivendi group, is part of the “Alliance to Better Protect Minors Online”, a European self-regulatory initiative initiated by the European Commission and aiming at better protecting minors online by improving the online environment for children and young people
